THE CONTEST IS
SCHEDULED TO BEGIN ON OR ABOUT 12:01 AM PACIFIC STANDARD TIME
ON January 1, 2008 AND END ON OR ABOUT 11:59 PM PACIFIC DAYLIGHT
TIME JUNE 1, 2008.
1. HOW TO ENTER THE ROAST MAGAZINE/ZEPHYR GREEN
COFFEE, LLC “2008
ROASTERS GUILD RETREAT Contest” (“Contest”):
Go to www.roastmagazine.com/Zephyr and
download the Official Entry Form. Fill it out completely and send
it by mail with your essay to
2008 Roasters Guild Retreat Contest, c/o Roast Magazine,
1631 NE Broadway, No. 125, Portland, OR 97232-1425.
The winner will be chosen on the basis of 25% originality, 25%
sincerity, 25% clarity of expression and 25% style. All entries
must be composed by and be the original work of the entrant, and
must not violate the rights of any third party. The essay may be
of any length. No responsibility is assumed for lost, late, incomplete,
stolen, misdirected, illegible or postage-due entries or mail delay.
To qualify your entry must be received by Roast magazine between 12:01 AM Pacific
Standard Time on January 1, 2008 and 11:59 PM Pacific Standard Time on June
1, 2008. There will be only one (1) winner.
Persons under the age of 18 are not eligible to enter or win.
CHANGE OF ADDRESS POLICY: It is the sole responsibility
of the entrant to notify the Contest judges in writing if the entrant
changes his or her mailing or e-mail address. To do so by e-mail,
submit changes to: roast@roastmagazine.com. To do so by U.S. Mail,
write to: 2008 Roasters Guild Retreat Contest, c/o Roast Magazine,
1631 NE Broadway, No. 125, Portland, OR 97232-1425.
Privacy, safety, and security are very important to Roast magazine and Zephyr
Green Coffee LLC (the “Sponsors”), and any submitted information
will only be distributed according to Sponsors’ Privacy Policy.
2. PRIZE:
The Contest winner will receive (a) round trip air transportation
on an airline to be selected by Sponsors from the airline’s
gateway airport within the continental United States that is
closest to the winner’s residence to the Roasters Guild
Retreat location (b) registration for the 2008 Roasters Guild
Retreat (“Retreat”),
(c) 3 nights’ accommodations at a hotel selected by Sponsors
at or near to the Retreat site, and (d) meals, excluding alcoholic
beverages, while at the Retreat up to a value of $1500. Gratuities,
ground transportation to and from the airports, and expenses
of friends or family members are not included and will be at
the winner’s expense. Should the winner reside in Hawaii,
he/she will only be eligible for airfare within the continental
U.S., and no cash equivalent or substitutions will be provided.
A minimum of 4 weeks’ notice must be given to Sponsors
by contest winner to make accommodations.
The prize has an approximate retail value of $1500, based on travel
from Portland, Oregon to the Roasters Guild Retreat. Actual retail value
will vary based on the departure point, hotel, airfare fluctuations
and dates of travel. All expenses not specifically mentioned here
are not included and are solely the winner’s responsibility.
In addition, Sponsors will not be responsible for airline delays
or cancellations, unavailability of hotel rooms or other hotel-related
problems. Sponsors will not replace any lost or stolen tickets.
3. CONDITIONS OF PARTICIPATION:
Sponsors are not responsible for lost, late, misdirected, damaged
or incomplete entries. Entry materials or other contest data
that have been tampered with or altered are void. In the event
this Contest is compromised in any way, electronically or otherwise,
Sponsors reserve the right to cancel, terminate, or suspend the
Contest. By submitting an entry, participants acknowledge that
all submissions become the property of Roast magazine, which
acquires all rights, including copyright, to the entry, and that
entries will not be acknowledged or returned. Winner will be
determined by Sponsors’ panel of judges, whose decisions
are final.
Contest is void where prohibited by law. Persons under the age
of 18 are not eligible to enter or win. The winner will be notified
by U.S. mail, overnight mail, or e-mail and will be required to
execute an affidavit of eligibility, liability release and publicity
release, consenting to the use of his or her name, likeness, statements
made, and/or photograph in connection with the Contest (where no
legal prohibition against such a requirement exists), and verifying
that he or she has complied with these Official Rules. In the event
that a winner does not properly execute such affidavit/release
within 14 days of notification, he or she will be disqualified
and the prize forfeited, and an alternate winner will be selected.
If a prize or prize notification letter is returned to Sponsors
or their designated agent as undeliverable, the prize will be awarded
to an alternate winner.
In the event that Sponsors send the winner notification by e-mail
and it is returned as undeliverable, Sponsors will attempt to re-send
up to three times. If no response is received within 14 days of
its transmission, or should the e-mail, after three attempts, be
returned as undeliverable, such potential winner will be disqualified
and an alternate winner will be selected.
Winners will be chosen within approximately ten days after the
close of the Contest and notified within approximately seven (7)
days after being chosen. No substitutions or cash alternates for
the prizes will be awarded, except at the sole discretion of Sponsors.
Prizes are not transferable, except at the sole discretion of Sponsors.
The Contest is subject to all applicable federal, state, and local
laws and regulations. The valid submission of entries in accordance
with these Official Rules is solely the responsibility of the participants.
Winners are solely responsible for any applicable sales, use, income,
or other taxes. Compliance with these Official Rules by each participant
is subject to verification. By entering, the participant agrees
to abide by and be bound by these Official Rules and by the decisions
of the judges, which are final and binding in all respects. It
is the participant’s responsibility to ensure that he or
she has complied with all of the conditions herein.
By participating in the Contest, winners release Sponsors and
agree to hold them and their subsidiaries, affiliates, agents,
suppliers, distributors, advertising and marketing agencies, and
their respective officers, directors, employees, investors, and
agents from and against any and all liability for any injury, loss,
or damage arising out of or in connection with participation in
the Contest, including without limitation the use or enjoyment
of any prizes won. Sponsors reserve the right, subject to any governmental
approval that may be required, to modify, suspend, or terminate
the Contest, in whole or in part, or modify the Contest in any
way, should any factor interfere with its proper conduct as contemplated
by these Official Rules.
4. ELIGIBILITY:
Contest is governed by U.S. law and is open to legal residents
of the United States. Void in all United States territories and
possessions including Puerto Rico, outside the United States,
and where prohibited by law. Employees, agents, and independent
contractors of Sponsors, their subsidiaries, affiliates, agents,
suppliers, promotional partners, distributors, advertising and
marketing agencies, and any persons involved in development,
production, distribution, or judging of the Contest, and any
immediate family (mother, father, sister, brother, daughter,
son, or spouse) of any person in the preceding categories, are
not eligible to participate or to win prizes.
5. NAME OF WINNER:
Participants may request the name of the winner by mailing, postage
pre-paid, a hand-printed self-addressed stamped envelope to:

for the name of the winner may be submitted per outer envelope,
mailed separately. All requests must be received between July
1, 2008 and August 31, 2008.
6. OFFICIAL RULES:
These Official Rules for the Contest will be posted on the Contest
webpage. You may also request a printed version of these Official
Rules by mailing, postage pre-paid, a hand-printed self-addressed
stamped envelope to: 2008 Roasters Guild Retreat Contest, c/o
Roast Magazine, 1631 NE Broadway, No. 125, Portland, OR 97232-1425.
Only one request for Official Rules may be submitted per outer
envelope, mailed separately. All requests must be received between
January 1, 2008 and June 1, 2008.
7. CHOICE OF LAW:
Except where prohibited, all issues and questions concerning the
construction, validity, interpretation, and enforceability of
these Official Rules, or the rights and obligations of participants
and Sponsors in connection with the Contest, will be governed
and construed in accordance with the laws of the State of Oregon,
without regard to its choice of law rules.
8. ARBITRATION:
Except where prohibited, as a condition of participating in the
Contest, participant agrees that any and all disputes and causes
of action arising out of or in connection with the Contest, or
any prize awarded, shall be resolved individually, without resort
to any form of class action, and exclusively by final and binding
arbitration under the rules of the American Arbitration Association,
and judgment may be entered upon the arbitration award in any
court of competent jurisdiction, and participant hereby waives
all rights to claim punitive, incidental, or consequential damages,
or any other damages, including attorney’s fees, other
than participant’s actual out of pocket expenses associated
with entering this Contest, and participant further waives any
right to have damages multiplied or increased.
